Terms of Service
Last updated · Markdown
The short version
- Today the Service is a free sandbox on synthetic data. It is for building and testing software, not for patient care.
- DermLiving returns reference knowledge. It is not medical advice and not a diagnostic tool.
- Don't send patient information.
- Use it fairly: stay within the rate limits, and don't attack or overload it.
- It is provided as is, without warranties. Delaware law governs these terms.
These terms govern your use of dermliving.com, the DermLiving API at api.dermliving.com (including its MCP endpoint), and the documentation, playground and tools we provide with them (together, the "Service"). The Service is provided by DermLiving. DermLiving is a portfolio company of Do Industries, Inc., a Delaware corporation. In these terms, "DermLiving", "we" and "us" mean both Do Industries, Inc. and DermLiving.
By using the Service, you agree to these terms and to our Privacy Policy. If you use the Service for an organization, you accept these terms for that organization and confirm that you have the authority to do so.
1. What the Service is today
The API, the MCP endpoint and the playground serve a synthetic sandbox: a small, made-up dataset published as "DermLiving Sandbox Reference". Its content is synthetic and has not been clinically reviewed, so it is not suitable for any real-world medical use.
The website also describes features that are designed or planned. Those are not part of the Service until we launch them.
2. Not medical advice
The Service provides reference information for software. It does not diagnose, score malignancy, choose or dose treatments, or triage, and it is not a substitute for a qualified professional. It is not intended for use in diagnosing, treating or preventing any disease.
You are responsible for how your software uses what the Service returns. That includes any review your use needs and the laws that apply to your product. Do not present the Service's output to patients or the public as medical advice.
3. Using the Service
The sandbox needs no key. If you use an id.org.ai identity, id.org.ai's terms also apply to it. Keep any credential you use secret. You are responsible for activity that uses it.
When you use the Service, you agree not to:
- send patient information or anything else that identifies a person's health;
- use the Service in breach of any law, or to harm anyone;
- probe, scan or test the Service's security without our written permission, or try to get around its rate limits or access controls (for example, by rotating addresses or credentials);
- put an unreasonable load on the Service, or interfere with other users;
- present the sandbox's synthetic content as real clinical content;
- resell, sublicense or rebrand access to the Service.
Automated access, including by AI agents, is welcome within the rate limits and our robots.txt. We may limit, suspend or end access that breaks these terms or puts the Service or other people at risk.
4. Your content
The questions and parameters you send remain yours. You give us permission to process them in order to provide the Service, as the Privacy Policy describes. We do not use them to train models.
5. Our content
The Service, the website, the documentation and the sandbox dataset belong to us or to our licensors. Within these terms, you may use the Service's responses and our documentation's examples and code samples to build and test your software. When we publish SDKs or other code, the license that ships with that code applies to it.
Terminology in the Service belongs to its publishers. ICD-10-CM is maintained by the U.S. National Center for Health Statistics, and ICD-11 by the World Health Organization. Your use of those codes is subject to their publishers' terms.
"DermLiving" and the sun mark are our trademarks. Do not use them in a way that suggests we endorse or sponsor you.
6. Feedback
If you send us ideas or suggestions, we may use them without any obligation to you.
7. Fees
The Service is free today. The prices on our pricing page are planned and are not charged. Before we charge for anything, we will publish the price and the terms that go with it, and paid use will require you to accept them.
8. Changes and availability
The sandbox is provided for development and testing. We may change, limit or discontinue any part of it, and we do not commit to any level of availability. The API is versioned with the DermLiving-Version header.
9. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, or that its content is complete or current.
10. Limitation of liability
To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from or related to the Service. Our total liability for all claims related to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim arose, or 100 U.S. dollars.
Some jurisdictions do not allow these exclusions or limits, so some of them may not apply to you.
11. Indemnity
You will defend and indemnify DermLiving and Do Industries, Inc. against third-party claims, and the losses and costs that come from them, arising from your breach of these terms or from your software's use of the Service.
12. Ending
You may stop using the Service at any time. We may suspend or end your access as section 3 describes, or if we discontinue the Service. Sections 4 to 6 and 9 to 15 continue to apply after your use ends.
13. Governing law
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute arising from these terms or the Service will be resolved only in the state or federal courts located in Delaware, and you and we consent to their jurisdiction. Nothing in this section removes protections that the law where you live gives you and that cannot be waived.
14. Changes to these terms
When we change these terms, we update the date at the top. If a change is material, we say so on this page before it takes effect. Using the Service after a change takes effect means you accept the new terms.
15. General
- These terms and the Privacy Policy are the whole agreement between you and us about the Service.
- If any part of these terms cannot be enforced, the rest still applies.
- If we do not enforce a part of these terms right away, we have not waived it.
- We may transfer these terms to an affiliate or to a successor. You may not transfer them without our consent.
- These terms do not create rights for anyone else.
16. Contact
We are setting up email for dermliving.com. When it is live, this section will give the address for privacy and legal requests. Until then, the site's forms are closed and the Service collects no account or contact details.
